The Panodyssey platform is published by Panodyssey Holding Group, a simplified joint-stock company registered with the Nanterre Trade and Companies Register under number 843 983 669 000 14, with its registered office at 10 rue Bapst in Asnières-sur-Seine (92 600) (hereinafter referred to as "Panodyssey").
The Panodyssey platform is accessible via a web browser at www.panodyssey.com.
It allows its Users, depending on the role they choose, to create, distribute, and view editorial content that is either freely accessible or requires payment; the language of the Content is freely chosen by the Creator/Contributor.
It acts as an intermediary between readers and authors.
Publishing and viewing Content is free; other optional services are offered for a fee (hereinafter referred to as "Paid Services").
These general terms of use ("GTU"), governed by French law, regulate the use of the Site. Accessing and browsing the Site and/or creating a Personal Space constitutes full and unconditional acceptance of the GTU by the User.
If the User refuses to comply with any of the obligations and conditions contained in these GTU or any other contractual documents, they are invited not to access or use the Site.
Simply accessing any page of the Website, regardless of the User's role, necessarily results in the formation of a Contract between them and Panodyssey Holding Group.
The general terms of sale described in Article 3 below (hereinafter "GTS"), govern the subscription to the Paid Services available on the Site. Subscribing to one or more Paid Services on the Site constitutes full and unconditional acceptance of the GTS by the User.
Terms written with a capital letter, whether singular or plural, shall have the meaning given below or at the place of their definition.
Accessing the Platform and using its services implies full acceptance of the GTU by the User.
The GTU is presented to each User upon Personal Space creation and must be accepted via a checkbox.
Panodyssey may modify the GTU at any time. Users must accept the new version upon first login after changes take effect.
Refusal to accept the GTU results in the inability to use the Site.
The Panodyssey platform is reserved for Users aged 15 or older, unless parental consent is provided with identity verification.
Paid content publication, paid content contributions, and subscription to Paid Services are reserved for Users aged 18 or older.
Users must provide accurate, complete, and up-to-date information when creating their Personal Space.
Users must select a strong password and validate their email address to activate their account.
Creators can produce Content, invite Contributors, and distribute Content through Creative Rooms.
Contributors can offer their skills to Creators and collaborate on Content.
Users can view free Content and, if subscribed, access Creative Room Content.
Users acknowledge that services are provided online and that Panodyssey has no control over internet availability.
It is recommended to use the latest versions of web browsers like Safari, Chrome, and Firefox for an optimal experience.
These general conditions constitute the entire agreement between the parties and take precedence over any other documents.
The User is deemed to accept them without reservation.
These terms define the rights and obligations regarding the purchase of Paid Services.
They apply only to services rendered in France for Users located in France.
Users must have a Personal Space to subscribe to Paid Services.
Orders are placed by selecting a Paid Service on the platform and completing the validation process.
Prices for each Paid Service are clearly stated on the subscription page.
Any order implies acceptance of the prices and descriptions of the proposed services.
The online provision of the User’s banking details and the final validation of the order shall constitute proof of the User’s agreement and shall imply:
After validation of the order, Panodyssey will send the User a confirmation email to the address provided when creating their Personal Space.

In the event that a Paid Service cannot be provided, the User will be informed by email. The cancellation of the order for this Paid Service and its possible refund will then be processed.

In case of fraudulent use of banking details, the User is invited, as soon as they become aware of it, to contact their bank as well as the Platform by email at: info@panodyssey.com.
The services governed by these general terms and conditions are the Paid Services offered on the Platform by Panodyssey to Users, namely:
They are offered within the limits of the provider's availability.
Panodyssey offers Users the possibility to financially support Creators and Contributors by making a donation of at least €1; this donation is purely voluntary and does not entitle the donor to any compensation.
Users are completely free to determine the amount and allocation of their donations.
By accepting these terms, the User declares that the funds used on the Platform do not originate from illegal activities and agrees not to use the Platform for any illegal or fraudulent activity, including money laundering.
Panodyssey provides a service that connects the User with the Creator/Contributor; it also ensures the administrative and financial management of the donation (implementation of online payment methods, collection of donor User information, controls to prevent money laundering, receipt of funds in the name and on behalf of the Creator’s Personal Space, allocation and disbursement of funds to the Creator’s dedicated account).
In return for these services, the Creator/Contributor compensates Panodyssey with 20% of the donation amount made by the User, excluding fees charged by the payment processing partner. Panodyssey does not collect any commission from the User; Panodyssey's remuneration is exclusively borne by the Creator/Contributor.
The Creator/Contributor expressly authorizes Panodyssey to deduct its Commission, as defined above, from the donation received on their behalf, before distribution.
To this end, the Creator/Contributor expressly mandates Panodyssey to receive, in their name and on their behalf, the sums paid by Users and to transfer them after deducting its Commission (Articles 1984 et seq. of the French Civil Code).
The Creator may decide to limit the Content available for free within their Creative Room.
In this case, they freely determine the subscription price, which is displayed on the subscription page of their Creative Room.
The User can subscribe to a plan that allows them to access Content, which the Creator restricts to subscribed Users only, in exchange for the payment of the price set by the Creator for access to this additional Content. The subscription is made by clicking the "subscribe" button on the Creative Room.
After subscribing and paying the subscription fee, the User has access to the additional Content for a duration of one month, calculated from date to date. At the end of each monthly period, the subscription is renewed for an additional month at the initial subscription price (if the subscription price is later changed by the Creator, the renewed subscription price remains unchanged until the subscription is canceled). The User can cancel their subscription at any time by clicking the "unsubscribe" button available on the Creative Room; the cancellation will take effect at the end of the current month.
In return, the User pays the Platform the subscription amount as specified on the Creator’s Creative Room. The Platform is then responsible for crediting, within thirty days at the end of the month, the Subscription amount—minus banking fees and the Platform’s Commission, which is set at 20% of the Subscription amount unless the Creator has subscribed to an offer allowing them to benefit from a reduced commission rate (see article 3.5.3 below)—to the User's Account.
Panodyssey thus acts as a commission agent within the meaning of Articles L.132-1 and L.132-2 of the French Commercial Code and Articles 1984 to 2010 of the French Civil Code regarding the principal-agent rules governing the relationships between the principal and the commission agent.
Panodyssey offers Creators the possibility to propose a "try&buy" service to Users subscribing for the first time to their Creative Room, which allows the Creator to offer Users the first monthly subscription period for free, calculated from date to date. At the end of this first monthly period, the subscription is renewed for an additional month at the price in effect at the time of the first subscription unless the User cancels the subscription.
Panodyssey offers service packages to Creators in the form of a monthly subscription, enabling them to increase the amount of data that can be stored on the Platform and optimize the Content publishing process in exchange for a monthly fee.
The Creator freely chooses and assumes full responsibility for the plan they wish to subscribe to.
After subscribing and paying the Subscription fee, the Creator gains access to the services included in the selected subscription plan for a period of one month or one year, calculated from date to date. At the end of the initial period, the subscription is automatically renewed for the same duration. The User may cancel their subscription at any time by visiting the cancellation page related to the Creative Room; the cancellation will take effect at the end of the current period.
In return for these services, the Creator pays Panodyssey the amount displayed on the Platform at the time of subscription.
Upon creating their Personal Space, the User has a User Account, where they can receive funds earned through Creator or Contributor Support and Paid Access to Additional Content.
The User Account is not a bank account.
When a User makes a donation to a Creator or Contributor or subscribes to a Creative Room, the Platform credits the relevant Creator/Contributor's User Account after deducting the Platform's Commission and financial fees.
Once the minimum threshold of €20 is reached, the User may choose to transfer the credited funds from their User Account to their own bank account by clicking the designated button, provided they have entered their bank details when creating their Personal Space.
If the Platform detects that a User has not logged into their Personal Space or requested a transfer from their User Account to their bank account for one year (calculated from date to date), the Platform will contact the User through the following process:
After the closure of a User Account, if the account had a positive balance, the funds will be placed in a dedicated escrow wallet for one month, pending a possible withdrawal request from the User or their legal successors.
If the User or their legal successors do not request the funds within one month from the date the registered letter was sent, the User expressly authorizes the Platform to use the funds as it deems appropriate, including allocating them, in whole or in part, to cultural project development or support for emerging creators. The Platform retains sole discretion in deciding how the funds will be allocated.
Prices are fixed and final. Unless otherwise expressly stated for a specific sale, the prices of Paid Services are those displayed on the Platform on the day of the order.
Panodyssey reserves the right to modify its prices at any time but commits to applying the rates in effect at the time of the order.
Prices are indicated in euros.
Prices include the applicable VAT on the day of the order and depend on the buyer's location.
Full payment of the price must be made at the time of the order.
As part of the payment process for products and services offered on the Platform, financial data related to the user's bank account or credit card is recorded.
The User freely determines the amount of the donation granted to the Creator/Contributor.
Panodyssey’s Commission, borne by the Creator/Contributor, corresponds to 20% of the donation made by the User, excluding fees charged by the payment processing partner.
The User agrees to pay Panodyssey the monthly fee specified on the Author's Creative Room in exchange for access to the Author’s Content, as described in Article 3.5.2.
The monthly fee is payable in advance. Any started contractual period is due in full.
The amount of the fee is determined based on the rates set by the Author and displayed on the Creative Room at the time of the order.
In case of subscription renewal, the subscription is extended for a period of one month at the price initially subscribed, which remains unchanged until the subscription is canceled.
The Creator compensates Panodyssey with 20% of the fee paid by the User, excluding fees charged by the payment processing partner, unless the Creator has subscribed to an offer allowing them to benefit from a reduced commission rate (see Article 3.5.3 above).
The User agrees to pay Panodyssey the monthly or annual fee in exchange for access to the Services referred to in Article 3.5.3.
The monthly or annual fee is payable in advance. Any started contractual period is due in full.
The amount of the fee is determined based on Panodyssey’s rates in effect on the day of the order, which depend on the selected offer.
In case of subscription renewal, the subscription is extended for the same period as the initial subscription at the price agreed upon during the first subscription, which remains unchanged until the subscription is canceled.
Panodyssey issues and sends the Creator an invoice for its service at the end of the month.
The service fee is invoiced in euros excluding taxes and is increased by applicable taxes at the rates in effect on the billing date.
The billing address is the one provided by the Creator/Contributor when creating their Personal Space.
Invoices are paid by deducting Panodyssey’s Commission from the donation amount paid by the User to the Creator.
Panodyssey invoices the User for the subscription fee at the time it becomes due, at the beginning of the month.
Subscription fees are invoiced in euros excluding taxes and are increased by applicable taxes at the rate in effect on the billing date.
The billing address is the one provided by the User when creating their Personal Space.
Invoices are payable upon receipt.
The Commission charged to the User is deducted from the subscription amount paid by the User and credited to the Creator.
Panodyssey invoices the User for the subscription fee at the time it becomes due, at the beginning of the month.
Any additional service requested by the User, not included in the subscription defined in Articles 3.5.2 and 3.5.3, will be subject to a separate invoice.
Subscription fees are invoiced in euros excluding taxes and are increased by applicable taxes at the rate in effect on the billing date.
The billing address is the one provided by the User when creating their Personal Space.
Invoices are payable upon receipt.
In all cases where Panodyssey does not receive or must refund funds paid by a User (Support for Creators or subscription to a Creative Room), for any reason whatsoever (including, for example, fraud in payment methods or the User exercising their right of withdrawal), Panodyssey shall be entitled, after informing by email the Creator/Contributor to whom these funds were to be transferred, to debit the User's Account for the corresponding amount previously credited to this User Account.
If an invoice remains unpaid by its due date, the Client shall automatically and without prior notice be liable for late payment penalties at an interest rate equal to three (3) times the legal interest rate.
Furthermore, Panodyssey may suspend the Services provided in exchange for the subscription until the User pays the outstanding amount.
The User shall also be liable for a fixed indemnity of forty (40) euros, as well as all reasonable expenses incurred by Panodyssey to recover the amount due. These expenses include legal and judicial fees as well as collection costs.
As the amounts paid by the User to financially support a Creator do not provide any counterpart, either in goods or services, the User does not benefit from the provisions of the Consumer Code relating to the right of withdrawal.
The non-professional User, as well as the professional User acting outside the scope of their profession, has, in accordance with the provisions of the Consumer Code, a period of fourteen (14) days from the date of the contract conclusion (the date of receipt of the confirmation email as specified in Article 3.4 of these terms) to exercise their right of withdrawal by informing Panodyssey of their decision to withdraw.
The right of withdrawal can be exercised online using the withdrawal form available on the Website. In this case, an acknowledgment of receipt on a durable medium will be immediately provided to the User. Any other method of withdrawal declaration is accepted as long as it is unambiguous and clearly expresses the intention to withdraw.
In case the right of withdrawal is exercised within the specified period, the price of the purchased Paid Service will be refunded to the User within fourteen (14) days from the withdrawal date.
For digital content not provided on a physical medium, the User may expressly waive their right of withdrawal to immediately benefit from the purchased services. In this case, Panodyssey will send the User an email before the withdrawal period expires, confirming their explicit agreement to access the services and their decision to waive the right of withdrawal.
The professional User acting within the scope of their profession does not benefit from the provisions of this article.
The non-professional User, as well as the professional User acting outside the scope of their profession, has, in accordance with the provisions of the Consumer Code, a period of fourteen (14) days from the date of the contract conclusion (the date of receipt of the confirmation email as specified in Article 3.4 of these terms) to exercise their right of withdrawal by informing Panodyssey of their decision to withdraw.
The right of withdrawal can be exercised online using the withdrawal form available on the Website. In this case, an acknowledgment of receipt on a durable medium will be immediately provided to the User. Any other method of withdrawal declaration is accepted as long as it is unambiguous and clearly expresses the intention to withdraw.
In case the right of withdrawal is exercised within the specified period, the price of the purchased Paid Service will be refunded to the User within fourteen (14) days from the withdrawal date.
The User may expressly request that the service begins before the expiration of the withdrawal period. In this case, Panodyssey will send an email to the User before the withdrawal period expires, confirming their explicit agreement to immediately access the services while the withdrawal period is still running. If the User withdraws within the fourteen-day period, the price of the purchased Paid Service will be refunded, minus "an amount corresponding to the service provided up to the communication of the withdrawal decision, proportionate to the total agreed price of the service," unless the service has been fully performed before the right of withdrawal was exercised.
The professional User acting within the scope of their profession does not benefit from the provisions of this article.
Panodyssey commits to providing the services defined in Articles 2.3 and 3.5 with the utmost care and in accordance with best practices in the IT field.
Its commitments constitute an obligation of means, whereby the services will be performed in strict compliance with professional standards and, where applicable, in accordance with the terms of the contract.
Panodyssey's liability for any breach, negligence, or fault arising during the execution of the services can only be engaged in cases of proven fault or negligence and is limited to foreseeable direct damages, excluding any indirect damage of any kind.
As a result, Panodyssey shall not be held liable for indirect or unforeseeable damages. By express agreement, the following shall be considered as such under this clause: loss of market opportunities, loss of clients, loss of revenue or profits, missed earnings, increased costs or expenses, and financial consequences of any actions taken by third parties against the User.
Panodyssey shall not be held liable for damages suffered by the User or third parties when using the Platform if such damages were caused by:
In any case, if Panodyssey’s liability is engaged, its liability shall be limited to the net amount paid by the User for the services provided (the commission received by Panodyssey for Creator Support and Paid Access to Additional Content, or the subscription fee in the case of Services for Creators).
Furthermore, the User is informed and acknowledges that Panodyssey has no control over the internet network through which the Platform is accessible and, therefore, cannot be held liable for any damage resulting from such a network. The User is also informed that, given the current state of technology, no security measure can completely eliminate all risks of data loss, alteration, misappropriation, or interception when transmitted over such a network, nor all risks of intrusion into any infrastructure connected to such a network, compromising the integrity, confidentiality, and overall security of the data stored. Under these conditions, Panodyssey does not guarantee the integrity, confidentiality, or general security of the User's Data.
The Creator and Contributor commit to using their real identity when creating their Personal Space on the Platform. The Creator and Contributor guarantee that their identity and other provided information are accurate, up-to-date, and complete.
The User is solely responsible for the use, protection, and confidentiality of their email address and password and releases Panodyssey from any liability in this regard. Any access to a User’s Personal Space using their email address and password, and any activity conducted on the Platform from this Personal Space, shall be deemed to have been performed by the User. In the event of unauthorized use of their email address or password, the User may contact Panodyssey at info@panodyssey.com to request the creation of a new password.
The User is solely responsible for their actions on the Platform, particularly for their creation or distribution of Content, and releases Panodyssey from any liability in this regard.
The User is informed that their civil or criminal liability may be engaged by another User, Panodyssey, or a third party due to their actions on the Platform, particularly in relation to their Content.
As a result, the User commits that their actions and Content will not violate applicable laws and regulations, third-party rights, or Panodyssey's rights, and will not cause harm to third parties or Panodyssey. In particular, the User commits that their Content will not infringe on intellectual property rights, privacy, personal attributes, or the honor and reputation of third parties. The User also agrees that their Content will not be pornographic or contrary to public order and morality.
Panodyssey does not monitor the actions or Content of Users on the Platform and is only responsible for the elements of the Platform that it directly publishes.
However, Panodyssey reserves the right to suspend or remove, without justification and without informing the concerned User, any Content that is reported or that it becomes aware of as being manifestly illegal, infringing on third-party rights, or harmful to a third party. Any User may report such Content to Panodyssey at info@panodyssey.com.
A rights holder, User, or third party who believes their intellectual property rights have been infringed by content published on the Platform by another User may report the alleged infringement using the copyright infringement notification form.
The User guarantees to Panodyssey that they hold the necessary copyright to grant the following rights to Panodyssey and to distribute the aforementioned Content, that this granting and distribution do not violate any commitments made by the User, and that the Content does not contain any elements that may infringe on third-party intellectual property rights or, more generally, third-party rights.
The User shall indemnify Panodyssey for any damages, irrecoverable costs, and expenses that it may be ordered to pay by a legally enforceable court decision or that may be imposed on it under a settlement resulting from a claim or legal action brought by a third party based on the fact that all or part of the Content constitutes an infringement of their rights and/or causes them harm. The User shall also indemnify Panodyssey for all costs and expenses incurred by Panodyssey in connection with such a claim or legal action.
Panodyssey collects personal data provided by the User when creating their Personal Space.
Panodyssey collects this personal data to manage the contractual relationship with the User, in particular to ensure the execution of the contract concluded with the User, to manage their Personal Space and activity on the Platform, to provide them with services, and to communicate with them.
Additionally, Panodyssey collects this data to inform the User about service updates and similar services that Panodyssey may develop, as well as to invoice the Platform's paid services and track the payment of invoices. This processing is based on the necessity of the User's personal data for the execution of the contract concluded with them. The processing of the User's email address is also based on Panodyssey’s legitimate interest in sending promotional messages about similar services.
Panodyssey also collects a copy of an identity document concerning the Creator or Contributor to validate their identity and age, to manage the contractual relationship, and to ensure the validity and proper execution of the contract. This processing is also based on the necessity of these personal data for the execution of the contract.
Finally, Panodyssey collects personal data provided by the User during a financial transaction to enable the payment of Paid Services purchased by the User. This processing is based on the necessity of these personal data for the execution of the contract.
The User’s personal data is intended solely for Panodyssey’s corporate officers and employees responsible for these tasks and may be indirectly and occasionally accessible to Panodyssey employees in charge of the administration and maintenance of the Platform and its operational environment. This data is transmitted to the servers of the Platform’s hosting provider, OVH, and may also be shared with other Panodyssey contractors involved in the aforementioned tasks.
The data is stored on the servers of the Platform’s hosting provider, OVH, located in mainland France.
When the User utilizes payment services, for the implementation of these services, the Platform collaborates with third-party banking and financial companies with which it has contracts. The references and general terms of use of these providers are available on the website www.panodyssey.com.
Panodyssey’s corporate officers and employees who have access to the User's personal data are bound by a confidentiality agreement under which they commit to maintaining its confidentiality. Moreover, access to the User's personal data is restricted to these officers and employees, who are the only ones with credentials allowing access.
Data exchanges with the Platform use the secure HTTPS protocol. The Platform's database is also backed up locally and on a "block storage," replicated on a second "block storage."
Panodyssey retains these personal data for three (3) years from the end of the contract with the User. Panodyssey then archives the necessary personal data in pseudonymized form to ensure the exercise and proof of rights for the duration of applicable limitation periods or due to legal obligations.
Panodyssey retains copies of identity documents only for the duration necessary for identity verification. Once the verification is complete, they are deleted.
In accordance with applicable French data protection laws, namely the law of January 6, 1978, on information technology, files, and freedoms, as amended by subsequent laws, and the General Data Protection Regulation (GDPR) of April 27, 2016, any User may, within the limits and conditions of the applicable legislation:
Any User may exercise these rights by providing proof of their identity and contacting Panodyssey at the following address: Panodyssey Holding Group, User Service, 10 rue Bapst, 92600 Asnières-sur-Seine.
Fees may be charged by Panodyssey for exercising these rights in cases of unfounded or excessive requests. In any case, the cost of extracting or copying personal data may be charged.
Users may also access and modify certain personal data directly from their Personal Space.
Furthermore, Panodyssey may suspend or terminate any Personal Space or contract, by operation of law and without judicial formalities, if it no longer has the necessary personal data to execute the contract due to the exercise of one of the rights mentioned above.
Any User also has the right to file a complaint with the CNIL or any other competent supervisory authority in case of a dispute regarding the processing of their personal data as described above.
Panodyssey owns all intellectual property rights to the Platform and all its components, except for the Content.
The User does not acquire any rights to the Platform and its constituent elements. The User is only authorized to use the Platform and its services for the duration of the Contract.
Any other action involving the Platform and its components is prohibited. In particular, any reproduction, representation, distribution, use, reverse engineering, or attempted reverse engineering of the Platform or its components is also prohibited. The same applies to modifying or attempting to modify the Platform or its components, including for error correction, as Panodyssey reserves this right.
Each Creator owns the copyright to the Content they create. Each Creator grants Panodyssey the right to reproduce and distribute their Content, whether free or paid, on the Platform, on Panodyssey's social media channels (Instagram, Twitter, LinkedIn, Pinterest, Medium, Facebook, etc.), and in Panodyssey’s newsletters, for the purpose of distributing the Content itself and promoting the Platform and Panodyssey. This right is granted for the duration of the contract and worldwide. Each Creator also grants other Users the right to access, display, save, and reproduce their Content for personal use; however, Users must refrain from sharing the Content with others. Panodyssey bears no liability in this regard.
Each Contributor acknowledges that their contributions to a Creator's Content are generally not protected by copyright. If otherwise, the Contributor assigns to the Creator, either free of charge or in exchange for an agreed percentage of the revenue from the Content they contributed to, all of their potential copyright on their contributions. This includes reproduction rights, representation rights, and exploitation rights, on all media, through all communication channels and electronic networks, whether known or unknown at the present time, for the entire duration of copyright protection and worldwide. Each Contributor also grants other Users the right to access, display, save, and reproduce their contributions for personal use. However, Users must refrain from sharing the Content with others. Panodyssey bears no liability in this regard.
The contract between the User holding a Personal Space and Panodyssey takes effect on the date of creation of the Personal Space and remains valid for as long as it exists.
The User may close their Personal Space at any time, which will automatically terminate the contract with Panodyssey, by operation of law and without judicial formalities. If a User’s Personal Space remains inactive for more than thirteen (13) months, Panodyssey will proceed with its closure, which will also result in the automatic termination of the contract with the User, by operation of law and without judicial formalities.
In the event that the User fails to fulfill any obligation under these terms, Panodyssey may suspend their Personal Space, thereby restricting their access to services, until the situation is remedied by the User.
If the aforementioned breach persists beyond thirty (30) days following a formal notice to remedy the issue referring to this termination clause, for a breach that can be corrected, Panodyssey may close the User’s Personal Space and terminate the contract automatically and without judicial formalities. If the breach is not subject to correction, Panodyssey may close the User’s Personal Space and terminate the contract automatically and without judicial formalities, with a fifteen (15) day notice period.
All data and digital or electronic files recorded within the Platform and its operational environment during the execution of the contract shall serve as evidence between the User and Panodyssey for the proof of facts to which they relate (including evidence of communications, orders, and payments made between the parties).
The archiving of order forms and invoices is carried out on a reliable and durable medium, which may be produced as evidence.
The consumer User, within the meaning of consumer law provisions, may resort to conventional mediation, including mediation before the Consumer Mediation Commission or existing sectoral mediation bodies, or to any alternative dispute resolution method (such as conciliation) in case of a dispute.
Any tolerance or waiver by a party in the application of all or part of the provisions of the contract, regardless of its frequency or duration, shall not constitute a modification of the contract, nor shall it create any rights or be interpreted as a waiver by that party to later invoke the relevant provisions.
In the event that any provision of the contract is deemed null, invalid, or unenforceable by law, regulation, or a final court decision, it shall be considered unwritten, and the remaining provisions of the contract shall retain their full force and effect.
The contract is governed by French law.
